1. Acceptance of Terms

By accessing and using TXTPIN ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use the Service.

2. Description of Service

TXTPIN provides a real-time messaging platform for metro station commuters in New York City and London. The Service allows users to share messages, alerts, and information with other users at the same metro station.

3. User Accounts and Conduct

Account Creation: You must create a username to use the Service. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Prohibited Conduct: You agree not to:

• Post false, misleading, or fraudulent information
• Harass, threaten, or abuse other users
• Use offensive, obscene, or hateful language
• Impersonate any person or entity
• Spam or flood the Service with excessive messages
• Share personal information of others without consent
• Violate any applicable laws or regulations
• Interfere with the Service's operation or security

4. Content and Intellectual Property

User Content: You retain ownership of any content you post. By posting content, you grant TXTPIN a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide the Service.

Service Content: All intellectual property rights in the Service, including design, code, and trademarks, belong to TXTPIN.

5. Message Retention and Deletion

Messages posted to the Service are automatically deleted after 12 hours. We reserve the right to remove any content that violates these Terms at any time without notice.

6. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. Please review it to understand our data practices.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TXTPIN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TXTPIN IS NOT AFFILIATED WITH, ENDORSED BY, OR SPONSORED BY THE MTA, LONDON UNDERGROUND, OR ANY TRANSIT AUTHORITY.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TXTPIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

9. Indemnification

You agree to indemnify and hold harmless TXTPIN from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice. You may delete your account at any time through the Service settings.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Privacy Policy

1. Information We Collect

Information You Provide:

• Username: A unique identifier you create to use the Service
• Messages: Text content you post to station chats
• Station Selection: The metro stations you choose to view and chat in
• Blocked Users: List of users you've chosen to block

Automatically Collected Information:

• Device Information: Browser type, operating system, device type
• Usage Data: Pages viewed, features used, time spent on the Service
• Technical Data: IP address, timestamps, error logs

2. How We Use Your Information

We use collected information to:

• Provide and maintain the Service
• Display your messages to other users at the same station
• Enforce our Terms and Conditions
• Improve and optimize the Service
• Detect and prevent fraud, abuse, and security issues
• Comply with legal obligations

3. Information Sharing

We Do Not Sell Your Data. We may share information in the following circumstances:

• Public Posts: Messages you post are visible to all users at the same station
• Service Providers: We use Firebase/Google Cloud Platform to host and operate the Service
• Legal Requirements: We may disclose information if required by law or to protect our rights

4. Data Retention

Messages: Automatically deleted after 12 hours

Account Data: Retained until you delete your account

Usage Logs: Retained for up to 90 days for security and analytics purposes

5. Your Rights and Choices

You have the right to:

• Access: View your account information and posted messages
• Delete: Permanently delete your account and all associated data
• Block: Prevent specific users' messages from appearing to you
• Opt-Out: Decline cookies through your browser settings (see Cookie Policy)

We implement industry-standard security measures to protect your information. However, no method of transmission over the Internet is 100% secure. We cannot guarantee absolute security.

7. Children's Privacy

The Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13.

8. International Users

The Service is hosted in the United States. If you access the Service from outside the US, your information may be transferred to, stored, and processed in the US.

9. Changes to Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting a notice on the Service.

Some browsers have a "Do Not Track" feature. Currently, there is no industry standard for how to respond to Do Not Track signals. We do not currently respond to Do Not Track signals.
